1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of BigShortAds, a software platform operated by SaveUN Grow Skill ("BigShortAds", "we", "us", or "our").

By accessing, registering for, purchasing, subscribing to, or using BigShortAds, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use BigShortAds.

If you are using BigShortAds on behalf of a business, organization, company, agency, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, "you" and "your" include both you and that entity.

2. Description of Services

BigShortAds provides software and digital tools related to social media management, customer engagement, automation, communication workflows, marketing assistance, AI-assisted features, social publishing, comment management, subscriber management, live chat, broadcasting, and related business automation services.

Features may include integrations with Facebook, Messenger, Instagram, Meta-related business assets, automation tools, AI-powered tools, subscription features, payment integrations, public website components, messaging tools, content-management tools, and other capabilities that we may make available from time to time.

The availability of specific services, features, modules, integrations, or functions may depend on your subscription plan, account permissions, geographic availability, third-party API access, technical requirements, connected-platform policies, or other applicable conditions.

BigShortAds is a software platform. We do not guarantee specific outcomes such as sales, lead volume, advertising performance, platform approval, account approval, policy approval, audience growth, revenue, conversion rate, or business success.

3. Eligibility and Account Registration

To use BigShortAds, you may be required to create an account and provide accurate, complete, and current information.

You agree that:

  • The information you provide is truthful, accurate, complete, and not misleading;
  • You will keep your account and business information updated where reasonably necessary;
  • You are responsible for maintaining the confidentiality and security of your account credentials;
  • You are responsible for all activities that occur under your account unless prohibited by applicable law;
  • You will promptly notify us of any unauthorized access, unauthorized use, security incident, or suspected compromise of your account;
  • You will not impersonate another person or entity or provide false registration information.

You must not share, transfer, resell, or provide account access in a manner that violates your subscription plan, our policies, applicable law, or the intended use of the service.

4. User Responsibilities

When using BigShortAds, you are responsible for:

  • All content, data, campaigns, comments, messages, automations, broadcasts, media, and communications you create, send, schedule, publish, upload, or manage through the platform;
  • Ensuring that you have all rights, permissions, licenses, consents, and authorizations necessary to use any connected account, Page, business asset, audience, contact list, message content, media, or third-party integration;
  • Ensuring that your use complies with applicable laws, platform rules, advertising policies, privacy requirements, consent requirements, anti-spam rules, messaging rules, and the requirements of connected services;
  • Monitoring your automations, AI-generated outputs, campaigns, broadcasts, scheduled content, integrations, and communications before and after use;
  • Using BigShortAds only for lawful and authorized business purposes;
  • Maintaining appropriate security over devices, accounts, credentials, API keys, access tokens, and connected services used with BigShortAds.

You remain solely responsible for the business decisions, campaigns, communications, content, automation rules, targeting decisions, account connections, and other actions taken through your use of the platform.

5. Connected Accounts and Third-Party Integrations

BigShortAds may allow you to connect or use third-party services, including but not limited to Facebook, Messenger, Instagram, Meta business assets, payment services, APIs, email services, artificial intelligence providers, hosting services, communication providers, and other technology platforms.

Your access to and use of those third-party services is also governed by their own terms of service, privacy policies, technical requirements, limitations, permissions, platform rules, and other applicable policies.

We do not control the ongoing availability, functionality, performance, approval status, security posture, policies, technical requirements, or business decisions of third-party services.

We are not responsible for:

  • Any action or inaction by Facebook, Meta, Instagram, or another third-party provider;
  • Suspension, restriction, removal, denial, limitation, or disabling of any connected account, Page, business portfolio, business manager, advertising account, API access, integration, permission, or other asset;
  • Changes in API permissions, authentication methods, feature availability, platform policies, pricing, limits, or technical requirements;
  • Downtime, outages, service interruptions, delays, or failures of third-party services;
  • Loss of data, functionality, access, revenue, or business opportunities resulting from third-party restrictions, outages, changes, or policy enforcement;
  • Any third party's decision to approve, reject, review, limit, or terminate your account, application, integration, content, advertisements, messages, or business assets.

6. Meta, Facebook, Messenger and Instagram Features

BigShortAds may offer features that rely on Meta-related services such as Facebook Pages, Messenger, Instagram, comments, subscriber management, automated replies, inbox tools, content publishing, business assets, customer engagement tools, and other supported workflows.

You may use such features only with accounts, Pages, business assets, permissions, audiences, contacts, and data that you are legally and contractually authorized to access and use.

You must not use BigShortAds in a manner that violates Meta policies, community standards, platform terms, messaging rules, developer policies, advertising policies, privacy requirements, or other applicable requirements.

You acknowledge that Meta and other third-party platforms may independently review, restrict, limit, suspend, remove, revoke, or modify functionality, permissions, connected assets, applications, accounts, or access at any time.

BigShortAds does not control or guarantee approval, continued access, verification, messaging limits, API access, feature eligibility, advertising eligibility, or policy decisions made by Meta or any other third-party platform.

7. AI-Assisted Features

BigShortAds may provide AI-assisted features such as reply suggestions, automated replies, content assistance, classification, summaries, workflow support, content generation, data processing, or related automation features.

AI-generated or AI-assisted outputs may be inaccurate, incomplete, misleading, inappropriate, outdated, or unsuitable for your intended purpose. You are responsible for reviewing, verifying, editing, approving, and monitoring all AI-generated or AI-assisted content and actions before relying on, publishing, sending, or deploying them.

You should not rely on AI-generated output as a substitute for professional, legal, financial, medical, accounting, compliance, or other specialized advice where professional advice is appropriate.

BigShortAds does not guarantee that AI outputs will be correct, complete, compliant, safe, original, error-free, or fit for any specific purpose.

8. Acceptable Use

You agree not to use BigShortAds to:

  • Violate any applicable law, regulation, court order, contractual obligation, or platform policy;
  • Engage in spam, harassment, deception, fraud, phishing, impersonation, manipulation, or misleading activity;
  • Send unauthorized, unlawful, deceptive, or unsolicited messages, comments, broadcasts, advertisements, or marketing communications;
  • Upload, publish, transmit, generate, distribute, or automate harmful, defamatory, infringing, abusive, obscene, hateful, threatening, deceptive, fraudulent, or unlawful content;
  • Use the service for illegal surveillance, abuse, stalking, unauthorized monitoring, or unauthorized collection of personal information;
  • Attempt to interfere with, disrupt, damage, disable, overload, or gain unauthorized access to BigShortAds, its infrastructure, servers, databases, users, networks, connected services, or third-party systems;
  • Reverse engineer, decompile, scrape, copy, reproduce, exploit, resell, sublicense, or misuse the software except where expressly permitted by us or required by applicable law;
  • Bypass subscription limits, plan restrictions, rate limits, technical restrictions, access controls, authentication mechanisms, or security measures;
  • Use automated methods to access the service in a manner not authorized by us;
  • Use the platform in a way that creates unreasonable infrastructure load, security risk, abuse risk, legal risk, financial risk, or operational disruption;
  • Use BigShortAds to assist with unauthorized access, credential theft, malicious software, fraudulent transactions, or unlawful activity.

We may investigate suspected misuse and may take appropriate action including warnings, removal of content, feature restrictions, access restrictions, account suspension, account termination, or other measures reasonably necessary to protect BigShortAds, our users, third parties, or connected platforms.

9. User Content and Data

You retain responsibility for the content, contacts, media, text, messages, automations, customer information, campaign information, and business data you upload, transmit, publish, store, generate, or process through BigShortAds ("User Content").

You represent and warrant that:

  • You own or have the lawful right, license, authorization, or permission to use all User Content you provide;
  • Your User Content and its use do not violate applicable law, contractual obligations, intellectual property rights, privacy rights, publicity rights, or the rights of any other person or entity;
  • You have obtained all required permissions, notices, authorizations, and consents for communications and data processing carried out through the platform;
  • You will not knowingly upload or process data that you are prohibited from possessing or using.

You grant BigShortAds and SaveUN Grow Skill a limited, non-exclusive, worldwide right to host, store, process, transmit, display, reproduce where technically necessary, and otherwise use User Content solely as reasonably necessary to operate, secure, maintain, provide, troubleshoot, support, and improve the services you use.

This limited right does not transfer ownership of your User Content to us.

10. Subscriptions, Packages and Billing

Some features of BigShortAds require a paid subscription, package, credit-based access, usage-based payment, or paid add-on.

By purchasing a plan, package, credit balance, add-on, or other paid service, you agree to the applicable pricing, plan limits, billing cycle, validity period, renewal terms if applicable, usage restrictions, feature availability, and other conditions displayed at the time of purchase.

Different plans may have different limits, enabled modules, connected-account allowances, automation quotas, usage quotas, feature restrictions, support levels, or eligibility requirements.

We may update, improve, modify, rename, replace, or discontinue plans, packages, pricing, limits, or features from time to time. Changes will apply subject to applicable law and any specific commitments associated with an active purchase.

Unless expressly stated otherwise or required by applicable law, fees are charged in advance and are generally non-refundable after the applicable service, subscription, package, credits, or features have been activated, delivered, or used.

11. Payments

BigShortAds may support payment methods such as Stripe, bKash, USDT, cryptocurrency-based methods, bank-related payment methods, or other supported payment channels that may be made available through the platform.

Available payment methods may vary depending on location, currency, transaction amount, account eligibility, provider availability, and other operational factors.

By making a payment, you authorize the applicable payment provider, processor, network, blockchain network, financial institution, or other service provider to process the transaction as applicable.

Payment processing may be handled by third-party providers, and their own terms, fees, policies, procedures, processing times, security requirements, and privacy policies may apply.

You are responsible for:

  • Providing accurate payment information where applicable;
  • Ensuring timely payment for active subscriptions, packages, credits, or purchased services;
  • Any bank, processor, network, conversion, transaction, or blockchain fees that may apply;
  • Using the correct payment amount, currency, wallet address, network, account details, and required payment reference where instructed;
  • Verifying payment information before submitting or sending a transaction.

For cryptocurrency or blockchain-related payments, transaction finality, confirmation timing, blockchain congestion, network fees, exchange-rate movement, wallet compatibility, and selected blockchain networks may affect processing.

A cryptocurrency, blockchain, or other payment is not considered complete until it has been successfully detected, confirmed, and verified by the applicable payment or verification system.

We are not responsible for funds sent to an incorrect wallet address, incorrect blockchain network, incorrect account, or unsupported payment destination where the error results from information entered or selected incorrectly by the user.

12. Refunds, Failed Payments and Chargebacks

Refund requests, if any, are evaluated according to the applicable plan, package, transaction, nature of the service provided, activation status, usage, fraud risk, technical evidence, payment status, and applicable law.

Except where required by applicable law or expressly stated otherwise, digital services, activated subscriptions, used credits, completed services, and consumed usage may be non-refundable.

We may refuse, reverse, suspend, restrict, or delay service activation where a payment is disputed, reversed, incomplete, unconfirmed, suspicious, fraudulent, unauthorized, or otherwise problematic.

If you initiate a chargeback, payment reversal, or payment dispute without first contacting support to attempt to resolve the issue in good faith, we may suspend or restrict the associated account, subscription, credits, or service while the matter is reviewed.

Submitting a payment dispute does not remove your responsibility for legitimate charges, outstanding amounts, or other obligations arising from your use of the service.

13. Service Availability and Changes

We aim to keep BigShortAds available, secure, and functional, but we do not guarantee uninterrupted, continuous, error-free, or delay-free operation.

The platform may be affected by:

  • Scheduled maintenance;
  • Emergency maintenance;
  • Third-party outages;
  • Hosting, server, database, network, DNS, or infrastructure issues;
  • API disruptions, restrictions, rate limits, permission changes, or deprecations;
  • Security incidents or protective security measures;
  • Software bugs, configuration issues, integration failures, or technical errors;
  • Feature updates, migrations, deprecations, replacements, or redesigns;
  • Events beyond our reasonable control.

We may modify, improve, suspend, replace, restrict, remove, or discontinue features, tools, modules, plans, integrations, APIs, user interfaces, or other parts of the service where reasonably necessary for technical, security, legal, business, policy, or operational reasons.

Where reasonably practical and required by applicable law, we may provide notice of material changes affecting paid services.

14. Intellectual Property

BigShortAds, including its software, user interface, layout, branding, logos, graphics, text, design, databases, source structure, workflows, documentation, and related materials, is owned by or licensed to SaveUN Grow Skill and is protected by applicable intellectual property and other laws.

Except for the limited right to access and use the service in accordance with these Terms, no ownership, title, source-code rights, trademark rights, copyright rights, database rights, or other intellectual property rights are transferred to you.

You may not copy, reproduce, modify, distribute, sell, lease, sublicense, publish, reverse engineer, decompile, create derivative works from, or commercially exploit BigShortAds or its proprietary materials except as expressly authorized by us in writing or required by applicable law.

Third-party trademarks, names, logos, software, integrations, and other materials remain the property of their respective owners.

15. Suspension and Termination

We may suspend, restrict, disable, limit, or terminate your account, access, subscription, API access, integration, or specific features if:

  • You violate these Terms;
  • You violate applicable law or connected-platform policies;
  • Your use creates or may create security, legal, financial, reputational, compliance, or operational risk;
  • Your payment fails, expires, is reversed, disputed, charged back, or remains unpaid;
  • We reasonably suspect fraud, abuse, unauthorized use, malicious activity, or harmful activity;
  • You attempt to bypass restrictions, security controls, subscription limits, or enforcement measures;
  • We are required to do so by applicable law, regulation, court order, government request, provider requirement, infrastructure provider, payment provider, or legitimate risk review;
  • Continued access could reasonably harm BigShortAds, SaveUN Grow Skill, another user, a third party, or a connected service.

Where appropriate, we may provide notice or an opportunity to address an issue before termination. However, immediate suspension or termination may occur where reasonably necessary for security, legal compliance, fraud prevention, payment risk, abuse prevention, or protection of third parties.

You may stop using BigShortAds at any time. Termination, account closure, or cessation of use does not automatically entitle you to a refund unless applicable law requires it or we expressly approve it.

Provisions that by their nature should survive termination, including provisions regarding intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, and dispute-related matters, may continue to apply after termination.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, BigShortAds is provided on an "as is" and "as available" basis.

To the maximum extent permitted by applicable law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, compatibility, or uninterrupted operation.

We do not warrant that:

  • The platform will always be available, uninterrupted, secure, timely, or error-free;
  • Any third-party integration will remain available, functional, approved, or compatible;
  • Any account, application, business asset, integration, advertisement, campaign, automation, or message will be approved by a third-party platform;
  • Any campaign, automation, message, publication, communication, or workflow will achieve a desired result;
  • Any AI-generated or AI-assisted result will be correct, complete, lawful, suitable, or appropriate;
  • The service will be free from delays, vulnerabilities, defects, outages, third-party failures, or other technical issues;
  • Data transmitted through third-party platforms will always be delivered, retained, or processed as intended.

Some jurisdictions may not permit the exclusion of certain implied warranties. Where such exclusions are prohibited, the applicable exclusions will apply only to the maximum extent permitted by law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, SaveUN Grow Skill, BigShortAds, and their respective owners, directors, officers, employees, contractors, affiliates, service providers, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of BigShortAds.

This includes, without limitation, loss of profits, loss of revenue, loss of business opportunities, loss of customers, loss of data, business interruption, loss of goodwill, campaign failure, account restrictions, platform bans, account suspension, advertising disapproval, integration failure, message delivery issues, automation errors, third-party enforcement actions, unauthorized access caused by user-side security failures, or loss arising from third-party services.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to BigShortAds or these Terms will not exceed the amount you actually paid to BigShortAds for the specific service giving rise to the claim during the three (3) months immediately preceding the event giving rise to the claim.

If applicable law does not permit a particular limitation or exclusion of liability, that limitation or exclusion will apply only to the maximum extent permitted by applicable law.

18. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless SaveUN Grow Skill, BigShortAds, and their respective affiliates, directors, officers, employees, contractors, licensors, agents, and service providers from and against claims, demands, liabilities, damages, losses, judgments, settlements, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • Your use or misuse of BigShortAds;
  • Your User Content, campaigns, messages, automations, broadcasts, advertisements, or communications;
  • Your violation of these Terms;
  • Your violation of connected-platform policies or applicable law;
  • Your infringement, violation, or alleged infringement of the rights of another person or entity;
  • Your unauthorized use of accounts, Pages, audiences, customer information, contacts, credentials, business assets, or third-party services;
  • Fraudulent, deceptive, unlawful, or abusive activity conducted through your account or at your direction.

We reserve the right, where legally permitted, to assume control of the defense of any matter otherwise subject to indemnification by you, and you agree to reasonably cooperate with such defense.

19. Privacy

Your use of BigShortAds is also subject to our Privacy Policy, which describes how information may be collected, used, processed, disclosed, stored, secured, and otherwise handled in connection with the platform.

By accessing or using BigShortAds, you acknowledge that you have reviewed the applicable Privacy Policy and understand that your information will be handled in accordance with that policy and applicable law.

Where you process personal information belonging to customers, subscribers, contacts, employees, users, or other individuals through BigShortAds, you remain responsible for ensuring that you have an appropriate lawful basis, notice, consent, or other authorization where required.

20. Data and Record Retention

We may retain account records, transaction records, payment records, invoices, system logs, security records, access logs, support communications, audit information, usage information, and other relevant records as reasonably necessary for operational, legal, accounting, tax, fraud-prevention, security, compliance, troubleshooting, enforcement, and dispute-resolution purposes.

The duration of retention may depend on the type of information, legal requirements, operational needs, contractual obligations, security concerns, and legitimate business purposes.

Termination or deletion of an account does not necessarily require immediate deletion of all associated records where continued retention is reasonably necessary or legally permitted.

21. Communications

You agree that we may send you service-related notices, security notices, legal notices, billing notices, transaction notices, technical notices, account notices, support replies, administrative messages, and other essential communications electronically.

Such communications may be delivered by email, in-app notification, dashboard notification, website notice, or other reasonable electronic means associated with your account.

You are responsible for keeping your contact details current so that important service-related communications can reach you.

22. Governing Principles

These Terms will be interpreted and enforced to the maximum extent permitted by applicable law.

If any provision of these Terms is determined by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision will be limited or modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Our failure or delay in exercising or enforcing any right or provision of these Terms does not constitute a waiver of that right or provision.

A waiver will be effective only if expressly made by an authorized representative and only with respect to the specific matter for which the waiver is given.

23. Changes to These Terms

We may revise, amend, or update these Terms from time to time to reflect changes in our services, features, plans, pricing, integrations, payment methods, legal requirements, regulatory requirements, platform policies, security practices, technology, or business operations.

When these Terms are updated, the revised version will be posted on this page and the "Last updated" date will be revised accordingly.

Where required by applicable law or where a change materially affects your rights, we may provide additional notice through the platform, email, or another reasonable method.

Your continued use of BigShortAds after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
